
When parents divorce, they face important challenges when it comes to their children. How will they make decisions, and how will they develop a parenting time schedule (commonly known as a ‘visitation schedule’) that will work for everyone? Parents who never married face similar challenges, but in addition will look to the Court to establish or challenge paternity. Each particular family will eventually work out an arrangement that suits their needs, often by agreement. Our attorneys regularly guide parents through this important process, advising the client along the way.
If parents don’t agree, the Court ultimately decides on schedules, and whether the parents will share decision-making. The Court may appoint an expert to conduct an investigation, where the expert meets with the parties, children and others in order to make recommendations to the judge about parenting time and decision-making. The Court will review these recommendations, listen to other facts, and ultimately enter an Order that it determines is in the best interests of the children.
