Maintenance can be awarded either on a temporary or permanent basis. Temporary maintenance, which goes into effect while the divorce proceedings are pending, may be awarded according to an income-based formula for lower income couples but may be subject to equitable principles for higher income couples.

Permanent maintenance may be determined according to a formulaic approach as well when the new Colorado maintenance legislation goes into effect on January 1, 2014. However, judicial discretion may still be exercised in determining “fairness” by consideration of case specific factors, including:

  • The duration of the marriage
  • The standard of living during the marriage
  • The age and health of both parties
  • The spouses’ education, employment prospects and earning capacities
  • The financial circumstances of both spouses
  • The outcome of property division
