In mediation, parties meet with an impartial individual for the purpose of reaching an agreement. In many Colorado jurisdictions, judges will order parties to participate in mediation once the case is underway. If parties are well-prepared and want to resolve matters out of court, mediation can be an effective method to resolve issues and preserve a cooperative relationship between the parties.

Parties usually have legal representation in a mediation session, and attorneys will draft the Separation Agreement that memorializes the agreements reached by the parties.

In arbitration, an impartial individual is chosen to decide contested issues. Sometimes, retired judges are chosen as arbitrators. An arbitration proceeding is similar in form to a hearing before a judge, where an attorney presents evidence and makes arguments on behalf of the client. The arbitrator’s decision is submitted to the Court for confirmation, and is binding. Parties will use arbitration when they want more flexibility in scheduling hearings than can be provided by the District Court in their county.
